DWI/DUI/DWAI

In New York, there is no way to expunge a criminal record, so a conviction for Driving While Intoxicated (VTL §1192.3), or Driving While Impaired by Drugs (VTL §1192.4),  or Driving With More than 0.08% BAC (VTL §1192.2), will result in a criminal record for the rest of your life.  If a new or existing job asks, “have your ever been convicted of a crime,” you must always answer, “Yes.” Remember also that a prior DWI can serve as a predicate basis for a future felony charge.  However, a conviction of the lesser charge of Driving While Impaired by Alcohol (VTL §1192.1),  is only a traffic infraction, not a crime, and "Impaired by Alcohol" cannot be the basis for a future felony charge.   Unfortunately, the District Attorney will not offer an impaired plea on any BAC reading above 0.12%.  Then the only way to get a reduction, and sometimes outright dismissal, is to aggressively and successfully attack the evidence . Too many attorneys just have clients plead guilty to a questionable criminal charge. Criminal defense lawyer Robert A.
