Not every test that checks your blood alcohol level comes up with accurate results. Police departments use various devices to test your BAC, such as: the Breathalyzer (Smith and Wesson Electronics, Springfield, MA), the Dräger Alcotest (Draeger Safety, Durango, CO), and the BAC Datamaster (National Patent Analytical Systems, Mansfield, OH). Like any manmade device, things go wrong with breath-test equipment, and police operator error is not uncommon. The police department must have these machines calibrated regularly to ensure the results are admissible in court. We will challenge the validity of these results by having the police produce the calibration and repair records. We also have a file for every breath-testing machine used in Orange County.

Obscure laws regulating chemical tests are often overlooked or disregarded.  For instance, most people don't know they have the absolute right to a second test:  "Right to Additional Test.  The person tested shall be permitted to choose a physician to administer a chemical test in addition to the one administered at the direction of the police officer." (VTL §1194[4][b]).  We raise legal objections and challenges when such rights are ignored.

Driving Under the Influence of a Drug
